Terms of service
Last updated: 1 October 2026
OVERVIEW
This website is operated under the trading name Brocely. Throughout these Terms of Service, the terms “Brocely”, “we”, “us” and “our” refer to the operator of the Brocely online store.
Brocely provides this website, including the information, content, features, tools, products and services available through it, collectively referred to as the “Services”. Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.
These Terms of Service, together with our Privacy Policy, Refund Policy and Shipping Policy, explain your rights and responsibilities when you access the website or purchase from us.
By accessing or using the Services, you agree to these Terms. If you do not agree, you must not use the Services. Nothing in these Terms affects any mandatory rights you have under applicable consumer law.
SECTION 1 – ELIGIBILITY AND ACCOUNTS
You must be legally capable of entering into a binding contract to place an order. If you are under 18, you may use the Services only with the involvement and permission of a parent or legal guardian.
You agree that the information you provide, including your contact, billing and delivery information, will be accurate, current and complete.
You are responsible for keeping your account credentials secure and for activity carried out through your account. You must notify us promptly if you believe your account has been accessed without permission.
You may also place an order using guest checkout where that option is available.
SECTION 2 – PRODUCTS AND PRODUCT INFORMATION
We take reasonable care to ensure that product descriptions, materials, dimensions, images, prices and availability are accurate. Colours and appearance may vary slightly depending on your screen, lighting and device settings.
Product photographs are intended to represent the item being sold. Any material, plating, stone, pearl, size or other product claim applies only as described on the relevant product page.
We may update product information or discontinue a product when necessary. If a material error affects an order you have placed, we will contact you and offer an appropriate solution, which may include cancellation and a full refund.
SECTION 3 – ORDERS AND CONTRACT FORMATION
When you submit an order, you are making an offer to purchase the products in your basket. An automated order acknowledgement confirms that we have received your order but does not necessarily mean that we have accepted it.
A contract is formed when we send you an order acceptance or dispatch confirmation, unless applicable law provides otherwise.
We may decline or cancel an order before acceptance where, for example:
- A product is unavailable
- Payment cannot be authorised
- The price or product information contains a material error
- Fraud is suspected
- Delivery cannot be made to the address provided
If we cancel an order after taking payment, we will refund the affected amount to the original payment method.
Please check your order and delivery information carefully before submitting it. If you need to request a change or cancellation, contact us as soon as possible at support@brocely.shop.
We cannot guarantee that a change can be made after an order has entered processing or has been dispatched. Your statutory cancellation rights are not affected.
Products purchased through the Services are intended for personal or household use and not for commercial resale.
SECTION 4 – PRICES, TAXES AND PAYMENT
Prices are displayed in pounds sterling (GBP) unless otherwise stated. Applicable taxes are included where required.
Any delivery charge or other amount payable will be shown before you submit the order.
We may change prices, discounts or promotions at any time, but changes will not affect an order that has already been accepted, except where permitted by law.
Promotional offers may be subject to additional terms displayed with the promotion.
You agree to provide accurate and authorised payment information. Payment is processed securely through Shopify and/or the payment provider shown at checkout.
We do not directly store full payment-card details.
SECTION 5 – SHIPPING AND DELIVERY
Our current delivery destinations, shipping charges, processing times and estimated transit times are described in our Shipping Policy and displayed at checkout where applicable.
Delivery dates are estimates. We will take reasonable steps to deliver within the stated timeframe, but delays may occur because of carrier disruption, severe weather, public holidays, customs processing or other circumstances outside our reasonable control.
If a material delay occurs, please contact us at support@brocely.shop.
You are responsible for providing a complete and accurate delivery address. Please contact us promptly if you notice an error. We may be unable to change an address after dispatch.
Risk in the products passes to you when the products are delivered to you or to a person identified by you to receive them.
Nothing in this section limits any rights you may have if goods are delayed, lost, damaged, faulty or not as described.
SECTION 6 – CANCELLATIONS, RETURNS AND REFUNDS
Returns, exchanges and refunds are handled in accordance with our Refund Policy and applicable consumer law.
Our Refund Policy explains:
- The return window
- Return eligibility requirements
- How to request a return
- Return methods
- Return-shipping responsibility
- Damaged or incorrect items
- Refund processing times
Please review the Refund Policy before placing an order.
Nothing in our Refund Policy or these Terms limits your statutory rights relating to goods that are faulty, damaged, not as described or otherwise non-conforming.
SECTION 7 – INTELLECTUAL PROPERTY
The content made available through the Services, including our trading name, logos, text, graphics, photographs, videos, page design and other materials, is owned by or licensed to Brocely or the relevant rights holder.
This content is protected by applicable UK and international intellectual-property laws.
You may access and use the Services for personal, non-commercial purposes.
You must not reproduce, distribute, modify, republish, sell or exploit our content without prior written permission, except where allowed by law.
Shopify and other third-party names, logos and trademarks belong to their respective owners.
SECTION 8 – OPTIONAL AND THIRD-PARTY TOOLS
We may provide access to tools or features supplied by third parties.
Those tools may be subject to the third party’s own terms and privacy policies. We do not control third-party tools and are not responsible for them to the extent permitted by law.
You should review the relevant third-party terms before using an optional tool.
SECTION 9 – THIRD-PARTY LINKS
The Services may contain links to third-party websites. A link does not necessarily mean that we endorse or control the third party or its content.
If you visit a third-party website, you do so subject to that website’s terms and privacy practices.
Complaints or questions about a third party’s products or services should be directed to that third party.
This section does not exclude liability that cannot lawfully be excluded.
SECTION 10 – RELATIONSHIP WITH SHOPIFY
Our store is powered by Shopify, which supplies the ecommerce platform used to provide the Services.
Purchases made from the Brocely store are made from Brocely, not from Shopify.
Shopify may process certain information and provide technical or payment-related services as described in our Privacy Policy and Shopify’s own privacy information.
Shopify is not the seller of the products offered by Brocely.
SECTION 11 – PRIVACY
Our collection and use of personal information is described in our Privacy Policy.
Because Shopify hosts the store, Shopify and other service providers may process information to provide the Services, process payments, prevent fraud, support delivery and operate the website.
Please read our Privacy Policy for information about:
- What information we collect
- Why we use it
- Who it may be shared with
- International data transfers
- Data retention
- Your privacy rights
SECTION 12 – REVIEWS AND FEEDBACK
If you submit a review, suggestion, photograph or other feedback, you confirm that it is truthful, relates to your genuine experience and does not infringe another person’s rights.
You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce and display the feedback for operating and promoting the Services, subject to applicable privacy and consumer-protection law.
We may moderate or remove content that is unlawful, misleading, abusive, defamatory, infringing, fraudulent, irrelevant or otherwise violates these Terms.
We will not knowingly publish fabricated reviews or materially alter a review in a way that misrepresents the reviewer’s opinion.
SECTION 13 – ERRORS AND UPDATES
Occasionally, the Services may contain typographical errors or inaccurate or incomplete information relating to a product, price, promotion, delivery charge, transit time or availability.
We may correct an error and update information.
If an error materially affects an order already placed, we will contact you before proceeding where required and provide an appropriate remedy.
We will not use this section to remove rights that you have under applicable law.
SECTION 14 – PROHIBITED USES
You must not use the Services:
- For an unlawful, fraudulent or malicious purpose
- To infringe our rights or another person’s rights
- To submit false, misleading, abusive, defamatory or unlawful material
- To distribute malware, spam, phishing messages or harmful content
- To impersonate another person or misrepresent your identity
- To interfere with the security or operation of the Services
- To collect another person’s information without a lawful basis
- To bypass access controls or technical protections
We may suspend or restrict access where we reasonably believe these Terms have been materially breached.
SECTION 15 – AUTOMATED ACCESS
Automated systems, agents, crawlers and similar tools must comply with applicable law, published technical instructions and reasonable access restrictions.
They must not:
- Conceal their automated nature
- Bypass security controls
- Solve or circumvent CAPTCHAs
- Interfere with the Services
- Complete a transaction without the customer’s valid authorisation
We may restrict automated access where necessary to protect customers, the website or our systems.
SECTION 16 – SUSPENSION AND TERMINATION
We may suspend or terminate access to an account or part of the Services where reasonably necessary because of fraud, misuse, security concerns, a material breach of these Terms or a legal requirement.
Termination does not affect rights and obligations that arose before termination.
Provisions that by their nature should continue, including intellectual property, privacy, liability and governing-law provisions, will survive termination.
SECTION 17 – SERVICE AVAILABILITY
We aim to keep the website accurate, secure and available, but we cannot guarantee that access will always be uninterrupted or error-free.
We may temporarily suspend access for maintenance, security or circumstances outside our reasonable control.
Products are supplied subject to the express information provided on the relevant product page and any rights or warranties required by law.
Nothing in these Terms excludes or limits implied terms or statutory remedies that cannot legally be excluded.
SECTION 18 – LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Mandatory consumer rights
If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not foreseeable, losses caused by matters outside our reasonable control, or business losses arising from a purchase made for personal use, except where the law requires otherwise.
SECTION 19 – YOUR RESPONSIBILITY
You are responsible for losses reasonably caused by:
- Your unlawful use of the Services
- Your material breach of these Terms
- Your infringement of another person’s rights
This section does not require a consumer to compensate us for losses that were not reasonably caused by their conduct and does not limit any mandatory legal protection.
SECTION 20 – SEVERABILITY
If a court or competent authority finds that any provision of these Terms is unlawful or unenforceable, that provision will be treated as modified to the minimum extent necessary or removed.
The remaining provisions will continue in effect.
SECTION 21 – WAIVER AND ENTIRE AGREEMENT
If we delay enforcing a provision of these Terms, that does not mean we have waived our right to enforce it later.
These Terms and the policies referred to in them form the agreement governing your use of the Services and purchases from us.
They do not exclude representations or rights that cannot lawfully be excluded.
SECTION 22 – TRANSFER OF RIGHTS
You may not transfer your rights or obligations under these Terms without our written consent, except where the law allows it.
We may transfer our rights and obligations to another organisation, provided that doing so does not reduce your rights.
We will notify you if a transfer materially affects you.
SECTION 23 – GOVERNING LAW
These Terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere, you retain any mandatory protections provided by the laws of your country of residence.
The courts of England and Wales will have jurisdiction. Consumers living in Scotland or Northern Ireland may also bring proceedings in their local courts where applicable.
SECTION 24 – CHANGES TO THESE TERMS
We may update these Terms to reflect changes to the Services, our business practices or legal requirements.
The current version and its “Last updated” date will be published on this page.
Changes will not retrospectively remove rights relating to an order already accepted.
Where required, we will provide reasonable notice of material changes.
